Alina Habba has left her position as New Jersey's top federal prosecutor. This comes after a legal ruling that challenged her eligibility to occupy the role.

Attorney General's Statement

The nation's top law enforcement official, the Attorney General, announced the prosecutor's departure on Monday. In a statement that the appeals court finding made it "untenable" for her to effectively run her office.

"Let no one confuse following the order as giving up," she declared. "This battle will now reach across America."

Judicial Challenge

Habba's exit was triggered by a judicial panel ruled that she had been acting without proper authority as the top prosecutor. This ruling is likely to affect many legal proceedings in New Jersey.

The judicial panel said that a acting appointment that did not receive confirmation by the US Senate ran afoul of the statute on vacant positions.

Ongoing Legal Battle

The Attorney General added that she will stay on at the Department of Justice as a senior adviser. Habba plans to seek further review of the court's action, aiming for a different outcome.

Writing online, Bondi contended that judges "must not override the President's choice of attorneys entrusted with executing the fundamental role of the presidency of prosecuting crime."

Record and Legacy

Bondi praised the prosecutor's work and said that while she was in charge, the city of Newark saw a one-fifth decrease in crime. She also stated that the Camden experienced its first summer in half a century free from homicides.

Background and Previous Role

Habba, first joined the former president's legal defense in recent years. She later represented the former president in his business records case in the previous year, when he was conviction on 34 counts of document fraud.

Prior to her appointment to the top New Jersey post, the former president had announced he was selecting her as his presidential counsellor if re-elected, calling her as "unwavering in her loyalty" and a relentless legal advocate.
